Acceptance

It is not necessary for you to have signed any document for these terms and conditions to apply.By commissioning any artwork from me, you are acknowledging that you have read, understood, and agree to these terms and conditions.

Pricing

All prices listed on my website(s) are in Canadian dollars (CAD) and are considered to be the "base" prices. The base prices are non-negotiable. Your cost may be higher depending on the scope of the service and any potential complexity fees.After I receive your application, I will send you a quote with the cost of this service. This cost is negotiable if you have incurred complexity fees. Payment means that you agree with the cost of service.

Refunds & Cancellations

I can offer partial refunds subject to the following conditions:1. If you need to cancel the commission:
     a) after paying the 50% deposit but BEFORE the sketch has been approved, I can give a partial refund. I will keep 25% of the total cost at minimum.
     b) after the sketch has been approved and work is ongoing, your refund will be reduced by the listed price of whatever the most recent work in progress ("WIP") would qualify as according to my prices.
     c) after work has been completed, no refunds will be issued.2. If I need to cancel the commission for any reason, you will be refunded in full regardless of progress.3. If communication breaks down on the part of the client for a period of 30 days (that is, you fail to reply to a communication from me), I will issue a warning email. If this email is not replied to within another 30 days, I reserve the right to terminate the commission. In this event, all deposits paid will be retained, and the commission will be cancelled.
If you wish to continue the commission at a later date, you will be required to request a new project quotation, and pay a further non-refundable deposit.

Revisions

My goal of course is to ensure all of my customers are satisfied, but there ARE limits to what I will alter at your request. I will only make revisions that are within the confines of the existing style and that do not greatly alter the scope of previously agreed upon work. I reserve the right to refuse to complete requested revisions for any reason.One (1) revision is offered free of charge. After that, there is a flat rate of $20 for each additional revision, as well as an extension of the expected completion date by one (1) day.

Time Frame

I will attempt to get my commissions done within 2 weeks to 1 month. This timeframe is subject to change depending on the complexity of the commission(s). I am disabled and cannot work every day, which influences my estimated delivery times.If you require the final work by a certain date, you will need to communicate that to me prior to the commission being accepted by me. If I do not believe I can complete the service in the time frame given, I reserve the right to refuse service.Once I begin work on the commission, if you require the work to be delivered prior to the date previously agreed upon, I will require a $20 fee in order to expedite your service.

Rights

Commissions are for personal use only. Artwork may be used as profile pictures/banners, but may not be used for profit.I own all rights to the work.Unless otherwise agreed, I am allowed to post the artwork to my social media and to include the artwork in my portfolio.Reposting and sharing the artwork is okay provided you give me proper credit through clear and visible labeling, tagging, or verbal acknowledgement.Putting my work into any AI engine is strictly prohibited.My artwork and commissions CAN NOT be used as NFTs - no exceptions.

Process

Upon starting, I will send progress images of the sketch for your review to approve or make revisions before I proceed to finish the artwork.If the commissioned work includes multiple elements (such as, but not limited to: flat colors, rendering, additional figures, backgrounds, etc.), I will make an effort to send additional work in progress ("WIP") images for your approval. By approving a WIP, you also agree that it's free of mistakes and that I can progress with the work.Once I am finished, I will send one final check for your review. Once you have approved the final check, I will deliver the final artwork to you, and this service will be finalized.Please note that all WIPs that are sent for approval will be heavily watermarked. These watermarks will not obstruct the view of the artwork so much that you will not be able to determine approval.

Payment

After applying, if I have accepted your commission you will be e-mailed a quote and I will invoice you through Paypal.PLEASE WAIT FOR THE INVOICE BEFORE SENDING PAYMENT.Payments received outside of these invoices will be treated as a tip, and as such are non-refundable.A deposit of at least 50% (NON-REFUNDABLE) must be paid before I start working. Once the sketch is approved, the remaining balance must be paid in full before I continue working and finish the commissioned artwork.

Delivery

Once the final work is complete and has been approved by you, the file(s) will be uploaded to a OneDrifve folder. A link will be sent to you for access to this folder. Anybody that receives this link will have access.I will leave the OneDrive folder available for 2 weeks after completion, unless otherwise requested, so it is vital that you download the file(s) to a secure location as soon as possible.Resending of the Final Work: If you require that the file(s) be sent again, I will require a $10 fee to do so. Full rendering, downloading, and uploading may be required again which takes significant time, and storage fees may apply for the OneDrive access.
